1. Biz kimiz ve bu koşulları nasıl kabul edersin
FREN'i Fren Safety Inc. geliştirir: Delaware'de (ABD) kurulu, New Jersey'de (ABD) faaliyet gösteren bir şirket ("biz"). İletişim: [email protected]
Bu koşullar, FREN uygulamasını ve uygulamanın bağlandığı hizmetleri kullandığında geçerlidir. FREN'i kurarak ya da kullanarak bu koşulları kabul etmiş olursun. Kabul etmiyorsan FREN'i kullanma. Hangi veriyi neden topladığımızı, ayrı bir belge olan Gizlilik Politikamız anlatır.
2. FREN nedir
FREN bir sürüş güvenliği uygulamasıdır. Kapsadığı ülkelerde:
- hız kameralarına ve hız koridorlarına (ortalama hızın denetlendiği yol kesimlerine) yaklaştığında seni sesle ve ekranda uyarır;
- bu özelliğin sunulduğu ülkelerde diğer sürücülerin canlı yol bildirimlerini gösterir ve senin de bildirim göndermeni sağlar: polis, seyyar radar, kaza, yol çalışması ve veri tabanımızda olmayan sabit radar (sunulan kategoriler ülkeye göre değişir);
- FREN'de henüz olmayan bir hız kamerasını bildirmeni sağlar (her bildirimi, kamerayı veri tabanımıza eklemeden önce inceleriz);
- FREN Premium kapsamında adım adım navigasyon sunar.
Kamera uyarıları telefonunun kendisinde üretilir ve internet bağlantısı olmadan da çalışır. Harita, arama, navigasyon ve canlı yol bildirimleri için internet bağlantısı gerekir.
FREN hız sınırını yalnızca hız kamerası noktalarında ve hız koridorlarının içinde gösterir. Yoldaki levhaların hız sınırını göstermez.
FREN bağımsız bir uygulamadır; Emniyet, Jandarma ya da başka bir kamu kurumuyla resmî bir bağı yoktur.
3. Önce güvenlik
- Bilgiler hatalı olabilir. Kamera konumları, hız sınırları, hız koridorları, rotalar ve canlı yol bildirimleri eksik, eski ya da hatalı olabilir. Yeni kameralar kurulur, eskileri taşınır ya da kapatılır; sürücülerin bildirimleri de yanlış olabilir.
- Uyarılar gecikebilir, hiç gelmeyebilir ya da sessiz kalabilir. Uyarılar telefonuna bağlıdır: GPS sinyali, konum izni, pil ve arka plan ayarları, ses düzeyi ve araçla bağlantı. Hiçbir zaman yalnızca FREN'e güvenme.
- Yol her şeyden önce gelir. Her zaman trafik işaret ve ışıklarına, trafik kurallarına ve polisin ya da jandarmanın talimatlarına uy. FREN ile levha farklı şeyler söylüyorsa levha doğrudur. Her zaman levhalardaki hız sınırına uy.
- Sürerken telefonu eline alma. Yola çıkmadan önce telefonunu tutucuya yerleştir ve varış noktanı gir. FREN'in uyarıları için telefona dokunman gerekmez. Araç hareket hâlindeyken telefonu elinde tutma, yazı yazma. Tek dokunuşla yapılan kısa işlemleri (ör. canlı yol bildirimi göndermek) yalnızca yasaların izin verdiği yerlerde ve güvenli olduğunda yap; daha da iyisi, bunu bir yolcudan iste.
- Nasıl sürdüğünden sen sorumlusun; sürüşünden doğan para cezaları, ceza puanları ve diğer sonuçlar da sana aittir. FREN'in amacı, trafik kurallarını çiğnemene değil, hız sınırına uymana yardım etmektir. FREN bir radar dedektörü de değildir: kamera konumlarını içeren bir veri tabanını okur, hiçbir sinyal algılamaz.
- Bulunduğun ülkenin kurallarını öğren. Bazı ülkelerde ve bölgelerde hız kameralarını haber veren uygulamaların kullanımı kısıtlıdır ya da yasaktır. FREN'i kullandığın yerde bunun yasal olduğundan emin ol; yasal olmadığı yerde kullanma.
4. Hesap gerekmez
FREN'i kullanmak için hesap açman gerekmez. Hız kamerası ve hız koridoru uyarıları telefonda ücretsizdir. Bazı özellikler için FREN Premium gerekir (5. bölüm).
5. FREN Premium, abonelikler ve ücretsiz deneme
- FREN Premium, App Store (Apple) ve Google Play (Google) üzerinden satılan, otomatik olarak yenilenen bir aboneliktir. Navigasyon ve araç ekranında kullanım (CarPlay ya da Android Auto) gibi ek özellikleri açar. Uygulamadaki satın alma ekranı, satın almadan önce nelerin dahil olduğunu ve fiyatı gösterir.
- Ödemeyi biz değil, Apple ya da Google alır. Kart bilgilerini görmeyiz. Satın alımın için onların koşulları, ödeme kuralları ve iade politikaları geçerlidir. İade talepleri Apple'a ya da Google'a yapılır.
- Ücretsiz deneme. Ücretsiz deneme varsa (ör. 7 gün) ve deneme bitmeden, mağazanın belirlediği süre içinde iptal etmezsen deneme sonunda ücret alınır. Apple'da iptalin, deneme bitmeden en az 24 saat önce yapılması gerekir. Denemeden kimlerin yararlanabileceğine mağaza karar verir.
- Yenileme. Abonelik, sen iptal edene kadar aynı süreyle (aylık ya da yıllık) otomatik olarak yenilenir.
- İptal için Apple Hesabı'nın abonelik ayarlarını ya da Google Play → Abonelikler bölümünü kullan. Uygulamayı silmek aboneliği iptal etmez. İptal ettikten sonra Premium, ödediğin dönemin sonuna kadar açık kalır.
- Fiyat değişirse mağaza seni kendi kurallarına göre önceden bilgilendirir.
- Telefon değiştirirsen aynı mağaza hesabıyla giriş yapmışken uygulamadaki Geri yükle düğmesine dokun.
6. Kullanım kuralları
FREN'i sürüşüne yardımcı olması için kullanabilirsin. Yazılı olarak başka türlü anlaşmadıysak şunları yapmayacağını kabul edersin:
- FREN'in kamera, hız koridoru ve harita verilerini ya da canlı yol bildirimlerini kopyalamak, çıkarmak, otomatik yazılımlarla toplamak, toplu olarak indirmek, satmak, yeniden satmak, yayımlamak ya da başka bir ürün yapmak için kullanmak;
- uygulamayı tersine mühendislikle çözmek, kaynak koduna dönüştürmek ya da değiştirmek; etkinleştirme kontrolünü, kurcalamaya karşı korumayı ya da abonelik kontrolünü atlatmaya çalışmak;
- sunucularımıza uygulama dışından erişmek, onlara bot ya da başka otomatik yazılımlarla istek göndermek veya onlara aşırı yük bindirmek;
- sahte ya da yanıltıcı bildirim göndermek ya da bildirimleri, kategorinin anlattığı durumdan başka bir şey için kullanmak;
- FREN'i yasalara aykırı ya da başkalarını tehlikeye atacak şekilde kullanmak.
Bu kurallara uymazsan FREN'in çevrim içi hizmetlerine erişimini kısıtlayabilir ya da durdurabiliriz.
7. Fikri mülkiyet
FREN (uygulama, kamera ve hız koridoru veri tabanı, tasarım, FREN adı ve logosu) Fren Safety Inc.'e ya da lisans verenlerine aittir. Sana kişisel, münhasır olmayan ve devredilemeyen bir lisans veriyoruz. Bu lisansla uygulamayı kendi ya da kullanımındaki cihazlarda, bu koşullara ve uygulamayı aldığın mağazanın kurallarına göre kullanabilirsin. Bunun dışında sana hiçbir hak geçmez.
FREN'in bazı bölümleri açık kaynaklı yazılımlar ve açık lisanslı veriler kullanır (ör. harita verisi © OpenStreetMap katkıda bulunanlar). Bu bölümler kendi lisanslarına tabidir.
Bir bildirim (canlı yol bildirimi ya da hız kamerası bildirimi) veya görüş gönderdiğinde, onu FREN'i çalıştırmak ve geliştirmek için, Gizlilik Politikası'nda anlatıldığı şekilde kullanmamıza izin vermiş olursun. Örneğin canlı yol bildirimlerini diğer sürücülere gösteririz; bildirdiğin kameraları da inceler, doğru olanları veri tabanımıza ekleriz.
8. Başka şirketlerin hizmetleri
FREN başka şirketlerin hizmetlerine dayanır. Örneğin: indirme ve ödeme için App Store ve Google Play; araç ekranı için CarPlay ve Android Auto; harita, arama ve rota için açık kaynaklardan ve başka sağlayıcılardan gelen veriler. Bu hizmetleri kullandığında onların kendi koşulları geçerlidir; bu hizmetlerden biz sorumlu değiliz. FREN'i App Store'dan indirdiysen Apple'ın standart Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesi (EULA) de geçerlidir.
9. Sorumluluk reddi ve sorumluluğun sınırlandırılması
Bu bölüm, yaşadığın ülkenin tüketiciyi koruyan emredici kurallarından doğan haklarını (ör. 6502 sayılı Tüketicinin Korunması Hakkında Kanun, Avrupa Birliği ya da Birleşik Krallık tüketici mevzuatı) sınırlamaz.
Kanunun kaldırılmasına izin vermediği sorumluluklarımız bu koşullarla kaldırılmaz ya da sınırlanmaz. Örneğin ihmalimizle yol açtığımız ölüm ya da yaralanmadan ve hileden sorumluluğumuz saklıdır. Bunun dışında, yasaların izin verdiği ölçüde:
- FREN "olduğu gibi" ve "erişilebildiği ölçüde" sunulur. Doğru, eksiksiz, kesintisiz ya da hatasız çalışacağını veya her kamerayı, hız koridorunu ya da tehlikeyi kapsadığını garanti etmeyiz.
- FREN'i kullanmandan ya da FREN'in verilerine ve uyarılarına güvenmenden doğan hiçbir kaza, yaralanma, para cezası ya da zarardan sorumlu değiliz.
- Kâr ya da zaman kaybı gibi dolaylı zararlardan sorumlu değiliz.
- FREN ile ilgili herhangi bir talepte sana karşı toplam sorumluluğumuz, talepten önceki 12 ay içinde FREN Premium için ödediğin tutar ile 50 ABD doları arasından hangisi yüksekse onunla sınırlıdır.
10. Değişiklikler
FREN'i güncelleyebiliriz: özellik ekleyebilir, değiştirebilir ya da kaldırabilir, FREN'i bir ülkede ya da tamamen sunmayı bırakabiliriz.
Bu koşulları da güncelleyebiliriz. Güncellediğimizde bu metnin başındaki versiyon numarası ve tarih değişir. Önemli değişiklikleri, yürürlüğe girmeden önce uygulamada ya da bu sayfada duyurmaya çalışırız. Bir değişiklik yürürlüğe girdikten sonra FREN'i kullanmaya devam edersen yeni koşullar geçerli olur. Kabul etmiyorsan FREN'i kullanmayı bırak ve varsa aboneliğini iptal et.
İstediğin zaman uygulamayı silerek FREN'i kullanmayı bırakabilirsin (varsa aboneliğini de mağaza hesabından iptal et).
11. Uygulanacak hukuk ve dil
Bu koşullar, yaşadığın ülkenin emredici tüketici koruma mevzuatı saklı kalmak kaydıyla, ABD'nin New Jersey eyaleti yasalarına tabidir. Bu, o mevzuatın sana tanıdığı, kendi ülkendeki mahkemelere ya da tüketici kurumlarına (Türkiye'de tüketici hakem heyetlerine ve tüketici mahkemelerine) başvurma hakkını ortadan kaldırmaz.
Bu koşullar Türkçe ve İngilizce olarak yazılmıştır. İki metin arasında fark olursa Türkiye'deki kullanıcılar için Türkçe metin, diğer herkes için İngilizce metin esas alınır.
Bu koşulların bir bölümü geçersiz sayılırsa geri kalanı geçerli olmaya devam eder. Bir hakkımızı hemen kullanmamamız, o haktan vazgeçtiğimiz anlamına gelmez.

1. Who we are, and agreeing to these terms
FREN is made by Fren Safety Inc., a Delaware corporation operating from New Jersey, USA ("we", "us"). Contact: [email protected]
These terms apply when you use the FREN app and the services it connects to. By installing or using FREN, you agree to them. If you don't agree, don't use FREN. Our Privacy Policy is a separate document that explains what data we collect and why.
2. What FREN is
FREN is a driving-safety app. In the countries it covers, it:
- gives you a spoken and on-screen alert as you approach speed cameras and average-speed corridors (stretches of road where your average speed is checked);
- in countries where that feature is available, shows live road reports from other drivers and lets you send your own: police presence, mobile speed cameras, crashes, work zones, and fixed speed cameras that are missing from our database (the categories offered vary by country);
- lets you report a speed camera that FREN doesn't have yet (we check every report before adding a camera to our database);
- offers turn-by-turn navigation as part of FREN Premium.
Camera alerts run on your phone and work without an internet connection. The map, search, navigation and live road reports need an internet connection.
FREN shows a speed limit only at speed camera locations and inside average-speed corridors. It does not show the speed limits on road signs.
FREN is an independent app. It has no official connection with any government agency or the police.
3. Safety first
- The data can be wrong. Camera locations, speed limits, average-speed corridors, routes and live road reports may be incomplete, out of date or wrong. New cameras go up, old ones move or are switched off, and drivers' reports can be mistaken.
- Alerts can be late, missing or silent. They depend on your phone: GPS signal, location permission, battery and background settings, volume, and the connection to your car. Never rely on FREN alone.
- The road comes first. Always obey road signs, traffic lights, traffic laws and instructions from the police. If FREN and a road sign disagree, the sign is right. Always drive within the posted speed limit.
- Don't hold your phone while driving. Mount your phone and set your destination before you drive. FREN's alerts are hands-free: you don't need to touch the phone to get them. Don't hold the phone or type on it while the vehicle is moving. Use quick one-tap actions (such as sending a live road report) only where local law allows it and when it is safe. Better still, ask a passenger.
- You are responsible for how you drive, and for any fines, points on your license or other consequences of your driving. FREN is meant to help you keep to the speed limit, not to break traffic laws. It is not a radar detector: it reads a database of camera locations and detects no signals.
- Check the local rules. In some countries and regions, apps that warn about speed cameras are restricted or banned. Make sure FREN is legal where you drive; if it isn't, don't use it there.
4. No account needed
You don't need an account to use FREN. Speed camera and average-speed corridor alerts are free in the phone app. Some features need FREN Premium (section 5).
5. FREN Premium, subscriptions and free trials
- FREN Premium is an auto-renewing subscription sold through the App Store (Apple) and Google Play (Google). It unlocks extra features, such as navigation and using FREN on your car's screen (CarPlay or Android Auto). The purchase screen in the app shows what is included and the price before you buy.
- Apple or Google bills you, not us. We never see your card details. Their terms, payment rules and refund policies apply to your purchase. Refund requests go to Apple or Google.
- Free trial. If there's a free trial (for example, 7 days), you are charged when it ends unless you cancel before the trial ends, following your store's deadline, which for Apple is at least 24 hours before the end. The store decides who is eligible for a trial.
- Renewal. Your subscription renews automatically for the same period (monthly or annual) until you cancel.
- Cancel in the subscription settings of your Apple Account or in Google Play → Subscriptions. Deleting the app does not cancel a subscription. After you cancel, Premium stays on until the end of the period you have paid for.
- If the price changes, the store tells you in advance, under its own rules.
- If you change phones, tap Restore in the app while signed in to the same store account.
6. Acceptable use
You can use FREN to help you drive. Unless we have agreed otherwise in writing, you agree not to:
- copy, extract, scrape, bulk-download, sell, resell or publish FREN's camera, corridor or map data or its live road reports, or use them to build another product;
- reverse-engineer, decompile or modify the app, or try to get around its activation, anti-tampering or subscription checks;
- access our servers other than through the app, run bots or other automated tools against them, or put an unreasonable load on them;
- send false or misleading reports, or use reports for anything other than what the category says;
- use FREN in a way that breaks the law or puts other people at risk.
If you break these rules, we may limit or stop your access to FREN's online services.
7. Intellectual property
FREN (the app, its camera and corridor database, its design, and the FREN name and logo) belongs to Fren Safety Inc. or its licensors. We give you a personal, non-exclusive, non-transferable license to use the app on devices you own or control, under these terms and the rules of the store you got it from. You don't get any other rights to FREN.
Some parts of FREN use open-source software and openly licensed data (for example, map data © OpenStreetMap contributors). Those parts are covered by their own licenses.
When you send a report (a live road report or a speed camera report) or feedback, you allow us to use it to run and improve FREN, as described in the Privacy Policy. For example, we show your live road reports to other drivers, and we check the cameras you report and add the correct ones to our database.
8. Services from other companies
FREN relies on services from other companies, for example: the App Store and Google Play for downloads and payments; CarPlay and Android Auto for the car screen; and map, search and routing data from open sources and other providers. Their own terms apply when you use them, and we are not responsible for those services. If you downloaded FREN from the App Store, Apple's standard Licensed Application End User License Agreement (EULA) also applies.
9. Disclaimers and limitation of liability
Nothing in this section limits the rights you have under the mandatory consumer protection laws of the country where you live, such as Turkish consumer law (Law No. 6502 on Consumer Protection) or the consumer laws of the European Union or the United Kingdom.
Some liability can't legally be limited (for example, for death or personal injury caused by our negligence, or for fraud), and we don't try to. Apart from that, and to the extent the law allows:
- FREN is provided "as is" and "as available". We do not promise that it will be accurate, complete, uninterrupted or free of errors, or that it covers every camera, corridor or hazard.
- We are not liable for any accident, injury, fine or damage that results from using FREN or from relying on its data or alerts.
- We are not liable for indirect losses, such as lost profit or lost time.
- Our total liability to you for any claim about FREN is limited to the greater of the amount you paid for FREN Premium in the 12 months before the claim or USD 50.
10. Changes
We may update FREN: add, change or remove features, or stop offering FREN in a country or altogether.
We may update these terms. When we do, the version number and date at the start of this English section change. We aim to announce important changes in the app or on this page before they take effect. If you keep using FREN after a change takes effect, the new terms apply. If you don't agree, stop using FREN and cancel any subscription.
You can stop using FREN at any time by deleting the app (and canceling any subscription in your store account).
11. Governing law and language
These terms are governed by the laws of the State of New Jersey, USA, without prejudice to the mandatory consumer protection laws of your country of residence. This does not take away any right those laws give you to go to the courts or consumer protection agencies of your own country.
These terms are written in Turkish and English. If the two versions differ, the Turkish text prevails for users in Turkey, and the English text prevails for everyone else.
If any part of these terms is found to be invalid, the rest still applies. If we don't enforce a right immediately, that doesn't mean we've given it up.
